Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you and HE Media, LLC regarding your use of the PeptideTrackr iOS app and related services. By downloading, accessing, or using PeptideTrackr, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. Description of Service

PeptideTrackr is a personal tracking tool for wellness supplements and prescribed medications. Features may include scheduling, logs, reminders, protocol organization, and subscription-based premium functionality. The service is informational and organizational only.

3. Medical and Safety Disclaimer

• PeptideTrackr does not provide medical advice, diagnosis, or treatment.
• PeptideTrackr is not FDA approved as a medical device.
• You must consult a qualified healthcare professional before starting, changing, or stopping any medication, supplement, or protocol.
• You are solely responsible for decisions made based on information entered into or viewed in the app.
• PeptideTrackr is not intended for emergency use. If you have a medical emergency, call 911 or local emergency services immediately.

4. Eligibility

You must be at least 17 years old to use PeptideTrackr and must have the legal capacity to enter a binding contract under applicable law. By using the app, you represent and warrant that you meet these requirements.

5. Accounts and Security

You are responsible for account credentials and all activities under your account. You agree to notify us promptly at support@peptidetrackr.app if you suspect unauthorized access.

6. User Responsibilities

• Enter accurate and current information.
• Use the app in compliance with applicable law.
• Consult your healthcare provider before acting on app-tracked data.
• Maintain security of your device and account.

7. Prohibited Uses

You agree not to:

• Copy, resell, sublicense, lease, or commercially exploit the service except as expressly authorized.
• Reverse engineer, decompile, or attempt to extract source code except where prohibited by law.
• Scrape, crawl, or use automated tools to access the service in unauthorized ways.
• Upload malware, harmful code, or content that is unlawful, infringing, abusive, or fraudulent.
• Interfere with security, uptime, or normal operation of the app or backend.

8. Subscription and Billing Terms

• Plans: $9.99 per month or $79.99 per year (USD), unless otherwise displayed in the App Store for your region.
• Billing and auto-renewal: subscriptions are billed through Apple In-App Purchase and automatically renew unless cancelled at least 24 hours before the renewal period, subject to Apple's terms.
• Managing and cancelling: manage or cancel in your Apple ID subscription settings on your device.
• Refunds: Apple handles refunds pursuant to Apple's refund policies; HE Media, LLC cannot directly issue App Store purchase refunds.
• Price changes: subscription pricing may change in the future with notice through Apple mechanisms and/or in-app notice as applicable.

9. Intellectual Property

The app, software, visual design, text, trademarks, and related content are owned by HE Media, LLC or its licensors and are protected by U.S. and international intellectual property laws. These Terms grant you a limited, revocable, non-exclusive, non-transferable license to use the app for personal, non-commercial use.

10. Suspension and Termination

We may suspend or terminate access to PeptideTrackr if you violate these Terms, create legal or security risk, or misuse the service. You may stop using the app at any time and may request account deletion under our Privacy Policy. Sections that by nature should survive termination will survive, including disclaimers, liability limits, indemnification, and governing law provisions.

11. Disclaimers of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEPTIDETRACKR IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR REQUIREMENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HE MEDIA, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO HE MEDIA, LLC FOR PEPTIDETRACKR IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

13. Indemnification

You agree to defend, indemnify, and hold harmless HE Media, LLC and its affiliates, officers, directors, and personnel from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the service, violation of these Terms, or violation of any law or third-party rights.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. You agree that any dispute arising from these Terms or your use of PeptideTrackr will be brought in state or federal courts located in Colorado, and you consent to personal jurisdiction in those courts, unless applicable law requires otherwise.

15. Changes to Terms

We may modify these Terms from time to time. If we make material changes, we will update the "Last updated" date and may provide additional notice in-app or on the website. Your continued use after updated Terms become effective means you accept the revised Terms.
